Is it legal to camp in the woods?

A couple of friends and I want to go camping in some woods. The woods have a small trail next to a creek, but people rarely use them. Is it legal to set up a tent for the night and just sleep there? Its not anyone's backyard, it may or may not be Township property, but even so, nature should be public.

In the USA dispersed camping is allowed in all of the national forests, some state forests and most BLM lands. City and local townships may have regulations for camping in their limits. If it is private property you will need permission of the land owner. How secure of an aera is a question I would have you said a trail passes throuh it to where from where?
